Prop 8 Back in Court Today
by Liz Colville
Today California’s Ninth Circuit Court of Appeals will be hearing arguments re: the state’s latest ruling on gay marriage, August’s decision by a San Francisco district judge that the 2008 gay marriage ban otherwise known as Prop 8 “violated constitutional guarantees to equal protection and due process.” Three judges will be in session today, and there are reports the case will go to a larger group of Ninth Circuit judges after this, then possibly to the Supreme Court. Today is really just about discussing legal issues, according to the Wall Street Journal, not hearing new evidence or questioning witnesses. One of the issues is whether Prop 8 supporters have “legal standing” to challenge the San Francisco court’s ruling. Let’s go with…no.
